General conditions of car rental
- Owner
The owner ECJ Justyna Bielec, also named ECJ, states to be the sole and legal disposer of the car mentioned overleaf and agrees to rent it to the Renter. - Renter
The renter is fully responsible for the rented car till the time when the vehicle is inspected by Owner’s employee during check-in process. The Renter receives the car in good driving condition, without damages and is obliged to return it in the same condition, together with the car registration document and car key. All comments on the condition of the car or damages should be reported to the ECJ employee at the time of check-out. The Renter is advised to leave the car on guarded parking lots whenever it is possible, to lock car doors, whenever the driver leaves it and to use all the security devices installed in the car. In order to avoid any disagreement concerning the condition of the vehicle the Renter should attend check-out and check-in of the car. - Additional driver
The Renter takes full responsibility for the rented car also in case if he/she renders a vehicle to another person. This situation can take place only after informing the Owner about this fact and presenting a valid driving license of the other driver. The personal data of each additional driver must be stated on the Rental Agreement and as consequence the charge according to the standard tariff will be applied. - Duration and extension of the rental
The contract starts at the time of signing the rental agreement and expires at the time of returning the vehicle. A request for extension of the rental must be made to the renting location not less than 12 hours prior to the expiration of the current rental period stated in the box “Date & Time in”. Otherwise the car may be reported as stolen. - Minimum rental period
Minimum rental period is 24 hours. Subsequent 59 minutes are free of charge. If the vehicle is returned later, the Renter will be charged for the next day. - Fuel
The vehicle is rented with a full tank and should be returned with the same amount of petrol. In case of any discordance, please inform ECJ employee immediately. Claims concerning this subject will not be honoured during the rental time or at the time of drop-off. It is Renter’s obligation to pay for the fuel used during the rental time and to refuel the car. If the vehicle is returned with less than a full tank the Renter will be charged as the fuel indicator shows. The charge for each lacking liter is indicated in the box “refueling”. Please check if the charge for missing fuel corresponds to the reading of the fuel indicator. Any claims regarding fuel made after closing the rental agreement will not be honoured. If a vehicle is refueled with wrong fuel (for ex. a diesel engine car is filled up with unleaded petrol) the Renter will be charged for exchange of car, refueling with proper fuel and all necessary repairs. - Currency of RA
The final chargé for the rental is made in Polish Zlotys. Rental Agreements opened in Euro will be converted into Polish Zlotys using an exchange rate of National Bank of Poland published on the last business day before closing the Rental agreement. Monthly rentals are paid in advance using the rate of exchange published on the last business day before opening the Rental Agreement. - Insurance
Each vehicle is rented with valid mandatory insurances.
8.1 By buying CDW and TP, Renter’s financial responsibility is case of collision, parking damages or theft is reduced only to Renter’s own responsibility described as “non waivable responsibility” (NWR). NWR is a flat fee aimed at covering cost of transportation and repair of the vehicle, loss of ECJ income resulting from the standstill of the car, decrease of car’s market value and as such does not require presentation of damage estimation or repair invoice.
8.2 Damages to the underside of the vehicle, the car interior, wheels and tires are not covered by any insurance and are fixed at the Renter’s full expense according to the real value of the repair plus possible cost of exchange of the car.
8.3 The change or repair of the damaged tire is Renter’s obligation and is done at his/her own expense.
8.4 CDW and TP is nil & void and the Renter takes full financial responsibility if damage or theft results from his/her willful action, gross negligence, or use of alcohol or drugs. All damages occurred as a result of carrying in the car explosives, dangerous or flammable materials are covered in full by the Renter.
8.5 Refusal to buy insurances offered by ECJ (CDW & TP) results in taking by the Renter all financial responsibility for the damage or theft.
8.6 Renter’s non-waivable responsibility can be lifted (except for damages specified in point 8.2) under the condition that the Renter buys additional insurance offered by the Owner: “SCDW” – against damages or “SCDWTP” – against damages and theft.
8.7 Vehicle insurance is valid on the territory of Poland. Crossing the border can take place only after obtaining permission from ECJ and paying Cross Border Traffic fee. It is Renter’s obligation to buy any additional insurance if it is required in the country of transit or country of final destination. Driving a car to Russia, Belarus, Ukraine, Moldova, Macedonia, Bosnia, Serbia, Montenegro, Bulgaria, Romania and Albania is forbidden.
- Accidents
In case of accident or collision the Renter is obliged to inform the Owner about the incident immediately. It is necessary to deliver copies of driving license and ID as well as complete accident report and appendix to notification of the damage to a vehicle. To avoid payment of Renter’s own responsibility fee (NWR) when accident is not caused by the Renter (except for parking damages) the Renter should provide the police report indicating circumstances of the damage, culprit of the damage together with his/her mandatory car insurance and his/her driving license. The purchase of any extra insurances does not release the Renter from following the above mentioned procedure. - Thefts
In case of theft of the rented vehicle the Renter is obliged to inform the Owner as well as the Police about the incident, return the car key and car documents immediately, together with the police report. Failure to comply with above duties results with Renters own responsibility for full value of the car. The purchase of any extra insurances does not release the Renter from following the above mentioned procedure. - Damages
In case of accident or car failure that makes impossible to continue the journey, the Owner will provide the Renter with a replacement car within 24 hours. No repairs can be carried out without knowledge and agreement of the car Owner. The cost of any unauthorized repairs, or cost of installation of any additional equipment will not be refunded. - One-way rentals
The conditions of one way rentals should be negotiated at the time of the rental or by phone during the time of the rental. In case the car returned in the other location or place than agreed without permission of the Owner, the Renter will be made to cover the cost of collecting the car. The charge for this action will be calculated by the Owner. - Traffic penalties
The Renter is responsible for any penalties or tickets for traffic law violation during the rental. Owner will bill the Renter for any related charges imposed by proper Polish authorities plus a 120 PLN administration fee for handling the charge. The Renter accepts that ECJ can reveal to the police or any other authority his/her personal details, as prescribed by law. - Final regulations
This rental agreement is governed by the law of Poland. In cases not regulated by the present Rental Agreement the provisions of the Polish Civil Code will be applied.
