JOLCAR rent a car
GENERAL RENTAL CONDITIONS
- Daily rates comprise 24 hours beginning from the time the car is available for the renter. If daily period is exceeded by more than 59 minutes, another day rate will be charged. The extension of the rental period must be reported to JOLCAR office at least 12 hours prior to the expiry of the current rental period. Otherwise the car may be reported as stolen. Unauthorized extension of the rental time without JOLCAR approval, will result in cancelling the Casco insurance conditions or other insurance guarantees.
- RENTER’S minimum age is 21 years for groups A, B and 25 years for others.
- The RENTER should have been in possessions of a valid driving license for at least 1 year and valid passport or ID card. The license must be valid in Poland.
- The rented car can be only driven by the person who signed a rental agreement.
- Crossing Polish border is forbidden without JOLCAR written permission. Driving outside Poland is determined by special conditions or restrictions which might change from time to time. JOLCAR cars are must not enter Estonia, Latvia, Lithuania, Belarus, Russia, Ukraine, Bulgaria, Romania, Albania, Serbia, Moldova and Montenegro.
That is why the RENTERS are asked to consult with JOLCAR any updates of rental conditions before the commencement and signing the rental agreement.
- Rates and fees are quoted in EUR, which are converted into PLN at the exchange rate announced by the National Bank of Poland on the day of car rental beginning . Prices and charges include the current VAT tax rates.
- The RENTER receives the car with a full tank and is obliged to return the car with a full tank.
Otherwise the RENTER will be charged with the cost of refilling the tank, that is 2,46 EUR per liter. The RENTER is obliged to refill the car with the proper kind of fuel.
- The RENTER must not in particular:
- get actively engaged in motor sports events, tow other vehicles
- allow any unauthorized person on any legal basis to use the rented car without the written permission
of JOLCAR
- carry goods, animals and other values forbidden and considered as illegal by Polish law, smoke cigarettes, tobacco and other similar substances.
- Violation of any conditions included in point 8 of General Rental Conditions will make the RENTER fully responsible for all minor or extensive damage of the rented vehicle.
- Damages of tyres, rims, hubcaps, windows, antennas, rear mirrors (including damages at the parking lot), the chassis of the car and wipers, as well as the interior of the vehicle (car equipment damage or damage caused
by breaching point 8 of General Rental Conditions) are not covered by the insurance and are removed at the expense of the RENTER.
- The change and repair of punctured tire, burnt bulb is done by the RENTER at his own cost.
- CDW, TP and any insurance conditions are breached and the RENTER takes full financial responsibility if the damage or theft results from the RENTER’s willful action, obvious negligence, use of alcohol, drugs or taking medicines forbidden to use before and while driving the car.
- In case of damage or car theft, the RENTER’s financial responsibility is limited to the amount of 246 EUR for the group “A”, “B”; 369 EUR for group “B+”, “C”, “C+”, “D”, “V”; 492 EUR for group “E”, “W” and 861 EUR for group “E+”, “SUV”. This is not a fully comprehensive insurance./ Limiting responsibility does not apply in every case.
- In case of accident, collision, damage or theft of the rented vehicle the RENTER must immediately inform JOLCAR and the police, return car keys and car documents and provide filled accident report and copy of his/her driving license and ID card. Failure to return keys, vehicle documents and filled accident report will result in making the RENTER responsible for covering the cost of the full value of the car or damage. To avoid the payment of RENTER’S financial responsibility ( point 13) , when an accident is not caused by the RENTER, the RENTER HAS TO provide a police report naming the person who caused the accident.
- When the rented vehicle during the rental period has been damaged, stolen or lost (all vehicle or part of it), the RENTER shall bear financial responsibility in accordance with the regulations of the Civil Code Act from 23 April 1964, ranging from the actual damage cost up to the car value. If the RENTER has accepted the terms of AC Insurance (Collision Damage Waiver and/or Theft Waiver), which are specified in General Rental Conditions, the liability might be limited to the amount of RENTER’s financial responsibility (point 13), provided that the RENTER has not violated any terms and conditions specified in this Agreement. However, if the damage was done deliberately or was the result of an obvious negligence on the part of the RENTER or by breaching the abovementioned conditions, the liability of the RENTER is unlimited.
Even in case of minor damage, the RENTER is obliged to provide JOLCAR with the written report containing the outline of the incident. It is especially vital that the report of the accident, collision or other incident should include the names and addresses of the persons and witnesses involved as well as the registration numbers of the cars and vehicles involved.
In case of theft or damage of the vehicle, rental agreement will be terminated on day of delivering the accident or theft report, in accordance with the date placed on the report.
- If the RENTER caused the accident and escaped from the place of accident, or did not fulfill his obligations specified in General Rental Conditions resulting from signing the rental terms, he shall be held fully liable for the damage to JOLCAR.
- If the RENTER loses keys or/and documents of the vehicle, he will be charged an additional fee in the amount resulting from the costs of restoring the loss and the related costs incurred by JOLCAR.
- Car return:
- after JOLCAR opening hours
- in situations which make the objective evaluation of the condition of the vehicle impossible
(dirt, night)
do not relieve the RENTER from liability for the rented vehicle. The RENTER’s liability expires after checking the car by a JOLCAR Representative the day after the returning the vehicle.
The RENTER will be still held liable for the damage under the following circumstances:
- the JOLCAR Representative will not confirm with his signature taking over the vehicle on “Vehicle Condition Report”
- the JOLCAR Representative will state the damage, which does not comply with the terms of General Renting Conditions, which have been accepted and signed by the RENTER.
- In case of technical damages or accident the JOLCAR will provide the RENTER with a replacement car within 24 hours from receiving the information about the case. No repairs can be done without knowledge and agreement of JOLCAR, except for repairs included in point 11 of General Rental Conditions. The RENTER will cover the costs of repairs described in point 11 and any other costs connected with installing additional equipment in the car. JOLCAR is not responsible for delays or losses caused by the failure of a car or other circumstances which prevent its exploitation.
- The RENTER is forbidden to leave car keys or car documents in the rented car .
- In case of damage, the deposit left at the beginning of the rental will be detained until the final clarification of the case and calculating the damage value.
- Additional agreements and appendixes concerning Car Rental Agreement require written JOLCAR permission
(possible e-mail form of correspondence).
- The RENTER is responsible for traffic offenses, that have occurred during the lease. The RENTER agrees that in justified circumstances JOLCAR will disclose the RENTER’s personal data to the Police and other authorized state bodies or the judicial institutions , respecting provisions of the Act on the Protection of Personal Data.
- This rental agreement has been drawn up in accordance with the Polish law. Any disputes that may arise with the reference to the terms of this agreement , the parties involved shall settle in the court of law in accordance with the provisions of the Code of Civil Procedure. If the RENTER runs business activity or does not have the legal residence in Poland, the only competent court to settle any disputes will be the court located in the area of JOLCAR office seat.
The personal data provided by RENTER in this agreement shall be processed by JOLCAR Morawska Jolanta
(the data controller) in order to support and implement the conditions included in the above rental agreement.
The data can be processed in order to fulfill legally justified aims pursued by the data controller. The legal basis: art. 23. 1 point. 2,3 and 5 of the Act of the Protection of Personal Data from 29 August 1997 Protection
