THE TERMS OF THE LEASE
an integral part of the lease
I. DEFINITIONS
The expressions in the lease and the terms of the lease mean:
1. Lessor - the person representing the company "MARCOM" Marcin Standura.
2. Lessee - the person who leases a car for himself and signs the lease.
3. Authorized Driver – the additional driver listed in the lease and approved by the Lessor. The Lessee also declares that the Authorized Driver will adjust to the terms of the lease.
II. REQUIRED DOCUMENTS AND FORMALITIES
1. Identity card / or passport / and driving license valid at least for two more years.
2. The required age of the driver ranges from 18 years to 75 years.
III. THE LESSOR’S ASSURANCE
1. The Lessor guarantees a good technical condition of the vehicle and that they have got all the necessary documents.
2. The Lessee receives the car with the full tank of fuel, and in such a condition it is to be given back. The cost of fuel on the lease is covered by the Lessee.
3. The Lessor provides the required equipment for the vehicle.
4. The car has a full insurance in accordance with the policy AC, OC. The insurance does not cover damage resulting from the use of alcohol, drugs, or other intoxicants. The insurance does not include damage for the loss of documents or the car keys, either, and damage below 1000 zł. If the vehicle becomes damaged, the Lessor deducts from the provision paid on account of damages.
IV. THE PERIOD OF THE LEASE
1. The settlement period is a day and it is calculated from the start of the lease.
2. An extension of the lease for more than 1hour results for the Lessee in being charged for the next day.
3. An unauthorised extension of the period of the lease for more than one hour causes the loss of the provision, and the Lessee wil be charged for any other costs associated with receiving the car.
4. Any deviation from the agreed period of the lease must be previously approved by the Lessor.
5. Any unauthorized use of the vehicle is treated as an appropriation, and is reported to the Police.
6. The landlord may, without giving reasons, request the return of the car during the term of the lease.
V. TERMS OF USE OF THE CAR
1. The car lease starts and ends in the same place.
2. The Lessee agrees to return the vehicle in the condition in which they have leased it.
3. If the Lessee dirties the vehicle, they must take into account the costs of cleaning, or wash and vacuum the car on their own. Cleaning costs are: Car wash - 30 zł gross vacuuming and washing inside - 20 zł gross Cleaning stains off the upholstery - 200 zł gross
4. The vehicle may be driven only by the Lessee, or the Authorized Driver listed in the lease.
5. The car does not have the right to cross the Polish border without a permission of the Lessor. The leased car is not allowed to cross / an absolute ban/ the border of the following countries: Russia, Ukraine, Belarus, Latvia, Lithuania, Estonia, Moldova, Albania, and of war/riot zones.
6. The car is not allowed to participate in races, rallies or competitions.
7. The Lessor must not carry goods illegal according to customs law, traffic law, or another kind of law, and goods inconsistent with the purpose of the vehicle.
8. The leased car must not be used by a driver under the influence of alcohol, drugs, or other intoxicants. Consequences arisin as a result of failure to comply with this prohibition are to be borne solely by the Lessee.
9. Without the consent of the Lessor, the car must not be used to gainfully transport persons or goods, which will result in the loss of the provision.
10. Towing other vehicles or trailers with the leased car is prohibited.
11. The Lessee must not leave their car documents, and keys in the car.
12. The Lessor shall not be liable for any loss of the Lessee due to the failure of the car.
13. The Lessee has to return the car with a set of keys and documents in a time and place specified in the lease. Failing to do so results in the Lessee’s obligation to pay for the damage / loss of the provision /
14. It is recommended that the vehicle be parked in guarded car parks, and that the Lessee take the valuables with them.
15. During the period of the lease, the Lessee is to take care of the car, and in particular, to check the oil level in the engine, as well as the level of the other vehicle fluids, to check the air pressure in the tyres. Failure to follow the above makes the Lessee guilty of any damage resulting from negligence.
16. If the Lessee has been notified of an impending MOT, they must not exceed the number of miles, at which the MOT is planned.
17. In case of an accident during the period of the lease, any possible repairs of the vehicle must get approval of the Lessor. Costs of an arbitrary repair are to be borne solely by the Lessee.
18. In the leased car no smoking or transport of animals is allowed. Doing so results in the loss of the
provision paid.
VI. THE COSTS OF THE LEASE
1. The price given concerns the lease for 1 day at a gross price and includes the cost of OC / AC / NW insurance.
2. The lease is paid in cash, in advance.
3. The provision, which is blocked for the period of the lease, is also paid in advance. Its return depends on the observance of the terms of the lease.
4. Lease rates per day are calculated according to website.
5. The amount of the provision is: 500 - 1000 zł, depending on the type of the leased vehicle.
6. Cancellation up to 24hrs. before the date of the lease makes the Lessee pay 50% of the rate per one day.
7. If the car is not given back with a full tank of fuel, the Lessor charges the Lessee for the additional amount of fuel up to the full tank, and a fee of 50 zł gross.
8. The amount paid at the time of the lease in the first place is accounted for possible events described in these terms of the lease, and then for the lease costs arising from the period of the lease, the number of kilometers covered and VAT.
VII. COLLISION, DAMAGE, THEFT
1. In case of an accident, damage or theft of the vehicle, the Lessee is bound to immediately inform the Lessor of the incident by phone 660 989 041 or e-mail: [email protected]
2. The Lessee is responsible financially for any loss resulting from gross negligence. In case of damage or loss of the vehicle, the Lessee shall give immediate notice of this fact to the Police and the Lessor. If the car has been damaged
as a result of a traffic collision caused by third parties, the Lessee is obliged to obtain a statement of the perpetrator’s guilt, and to elicit the data from the perpetrator concerning the insurance policy OC.
3. The Lessee is obliged to deliver to the Lessor within 48 hours the accident report, the current driver's license and a photocopy of the identity document of the driver and the car keys and documents, the police report identifying the perpetrator.
4. In the absence of further unassisted movement capabilities of the car, the Lessee, in consultation with the Lessor, is obliged to secure the vehicle.
5. The Lessee is responsible financially for minor damage to the upholstery, scratches or dents of the body, damage to tyres and rims at price of repairs according to the rates of an authorized dealer.
6. If the Lessee fails to fulfill the obligations set out in this paragraph, they are required to pay a penalty amounting to 1000.00 zł.
7. The Lessee’s share of the damage in case of not identifying the perpetrator is 1000 zł.
VIII. OTHER INFORMATION
1. The Lessee agrees to store his personal data in the Lessor’s documents. If the payments are not made or false documents are provided – the personal data are sent to a warning file called: ,, the black list "and to the National Debt Register.
2. The Lessee authorizes the Lessor to issue VAT invoices without his signature.
3. The Lessee agrees to receive invoices and other documents electronically to the email address specified in the lease, including any statements of intent, summons and notices.
4. Messages and documents sent to the email address of the Lessee shall be deemed to have been delivered at the time of sending them to the email address indicated by the Lessee.
5. Any disputes arising out of the aforementioned lease will be settled by the Court by the seat of the Lessor.
6. If the terms of the lease are not conformed to, the Lessor has the right to transfer the personal data of the Lessee to the authorities involved in law enforcement.
7. The Lessee consents to the processing of personal data in connection with booking, lease, the repair of communications damage and for marketing purposes in accordance with the Act on the Protection of Personal Data of 29 August 1997 (Dz.U. 2002r., nr 101, poz 926 ze zm.)
