§1 General Provisions-
The Lessor is Simply Sp. z o.o., with its registered office in Warsaw, Al. Krakowska 110/114, NIP: 5223212931.

The Lessee is a natural or legal person who enters into a rental agreement and collects the vehicle on the basis of the handover protocol.

These Regulations, together with the rental agreement and annexes, constitute an integral whole and define the rights and obligations of the parties.

In matters not regulated herein, the provisions of the Polish Civil Code shall apply.

The subject of the rental is a passenger car of the make, model, and registration number indicated in the agreement and in the handover protocol.

The vehicle is technically sound, has valid third-party liability (OC), comprehensive (AC), and accident (NNW) insurance, as well as a valid technical inspection.

Together with the vehicle, the Lessee receives a set of keys, the registration certificate, an insurance policy, and the equipment listed in the handover protocol.

The handover of the vehicle takes place on the basis of a handover protocol signed by both parties.
-
The return of the vehicle takes place at the agreed place and time, also on the basis of a handover protocol.

The Lessee undertakes to return the vehicle in a condition not worse than normal wear and tear resulting from proper use.

Any damages, missing equipment, or dirt found upon return shall be charged to the Lessee.

The Lessee is obliged to:
-
use the vehicle in accordance with its purpose and the law,
-
maintain the technical condition (operating fluids, tire pressure, oil),
-
immediately report to the Lessor any faults, damages, or collisions,
-
keep the vehicle clean inside and outside.

The following are prohibited:
-
leaving the territory of the Republic of Poland without the Lessor’s written consent,
-
handing over the vehicle to third parties,
-
smoking in the vehicle or transporting materials that may soil or damage the interior,
-
driving with the fuel indicator in reserve,
-
using the vehicle in a manner exceeding normal daily use,
-
transporting hazardous materials,
-
participating in rallies, races, or sports events,
-
using the vehicle for unlawful activities.

The agreement is concluded for a definite period (with the possibility of extension) or for an indefinite period, in accordance with the provisions of the contract.
-
The rental period begins on the day of the protocol handover of the vehicle.
-
In the case of fixed-term contracts, the agreement expires upon the end date, unless extended.
-
The Lessee undertakes to pay rent in the amount and within the deadlines specified in the agreement.

The weekly fee includes the mileage limit indicated in the agreement. Each kilometer above the limit is subject to an additional fee according to the price list.

The rent is payable by bank transfer to the Lessor’s account or in cash at the office.

The Lessee pays a deposit in the amount specified in the agreement. The deposit may be deducted for penalties, damages, fines, and other dues, and will be refunded within 30 business days after proper termination of the contract and return of the vehicle.

Vehicles are covered by OC, AC, and NNW insurance.

The Lessee is responsible for any damage not covered by the insurance, as well as for damage caused by intent, gross negligence, or breach of these Regulations.

In the case of damages settled under AC/OC, the Lessee may be charged up to PLN 30,000, but not exceeding the Lessor’s deductible.

Fines and road charges during the rental period shall be borne by the Lessee. For handling each fine, the Lessor charges an administrative fee of PLN 150.

In the event of an accident or collision, the Lessee is obliged to immediately notify the police and complete an accident report. Failure to do so results in the Lessee’s full liability.

The Lessor’s vehicles may be equipped with a GPS monitoring system. Data from the system may be used in disputes concerning mileage, location, or driving style.

The Lessor may terminate the agreement with immediate effect if the Lessee is more than 1 day late with payment, breaches the Regulations, or uses the vehicle contrary to its purpose.

The Lessee may terminate the agreement with 14 days’ notice (unless the agreement provides for a shorter period).

Termination must be made in writing under pain of nullity.

For each day of delay in rent payment, the Lessor may charge a contractual penalty of PLN 100.
According to Annex No. 1 to the rental agreement:
-
Failure to return the vehicle on time – PLN 300
-
Smoking in the vehicle – PLN 500 + upholstery cleaning and ozonation costs
-
Loss of keys/documents – PLN 600 per item
-
Subletting the vehicle – PLN 5,000
-
Driving with the fuel indicator in reserve – PLN 100
-
Damage to equipment – according to market value
-
Damages not covered by OC/AC – up to PLN 30,000
-
Other penalties in accordance with the current annex

These Regulations come into force on the date of signing the agreement.

Disputes shall be settled by the court competent for the Lessor’s registered office.
